On Thursday, Kiren Rijiju, The Union Minister Of Minority Affairs, Decided To Send The Waqf (Amendment) Bill, 2024 To A Joint Committee Of Parliament To Be Named By Lok Sabha Speaker Om Birla. That Would Include Members From All Political Parties. Upon The Formation Of The Joint House Panel, He Also Said That He Would Be Available For Consultation With Interested Parties.
Things Got Worse When Rijiju Tried To Answer From The Lok Sabha Opposition Members Who Were Against The Introduction Of This Bill Saying, “Unconstitutional, Ant-minority And Divisive”.
“I Will Completely Clear Any Misunderstanding About The Bill. The Constitution’s Protection Of Religious Freedom Stays Untouched. Those Who Used To Have No Room Earlier Have Got Rights Through This Bill. It Includes Backward Muslims Who Were Oppressed Earlier Along With Muslim Women,” Said Rijiju.
Regarding The Statement, “The Minister Said The Waqf Act Modified In 1995 Couldn’t Fulfill Its Intended Design, Claiming, ‘certain Persons Have Seized The Entire Waqf Board,'” This Bill Is To Bring Justice To All Muslims.
The Waqf Amendment Bill The Bill Proposes A Variety Of Major Changes, The Most Important Of Which Includes The Allowing Of The State Government To Appoint A Non-muslim Chief Executive Officer And A Minimum Of Two Non-muslim Members In The State Waqf Boards. A Different Point Is The Proposition To Appoint The District Collector As The Judge On Whether A Plot Of Land Is Government Land Or Waqf Property.
Rijiju Recalled That A Waqf Enquiry Report Of 1976 Indicated That Appropriate Measures Be Carried Out To Rationalize The Tribunal System To Get Rid Of Many Pending Cases.
He Quoted That, “It Further States That The Accounts Maintained And Audits Conducted By The Waqf Board’ Were Not Proper And “Need To Be Improved”. According To The Sachar Committee Report, 4.9 Lakh Registered Waqf Properties Generate An Annual Revenue Of Rs 163 Crore.
It Said That Rs 12,000 Crore Would Be Generated Every Year If They Were Managed Well. As A Minister, I Can Assure You That If The Revenues Can Well Be Increased And It Can Much Quickly Be Over Rs. 12,000 Crores.
The Committee Also Recommended Having A More Significant Representation For Women In The Waqf Board Besides Suggesting That The Central Waqf Council And State Waqf Boards Have Two Women. According To Rijiju, The Current Bill Is In Consonance With The Recommendation Of The Sachar Committee.
Rehman Khan, Declare That The Joint Committee Of The Congress Lawmaker Found That The Waqf Board Faces A Shortage Of Staff And Infrastructure, Rijiju Added That It Also Included The Holding Of Proper Documentation, Computerization, A Central Database The Same And The Waqf Act To Be Reviewed.

In A Democracy, Is That Appropriate? Our Constitution Bars Having Any Super Laws But The Waqf Act, 1995 Became A Super Law.
However, He Criticized The Current Legislation And Pointed Out That If, In The Long-distant Past, One Could Prove That Their Ancestors Had Said The Namaz On A Certain Piece Of Land, The Law Would Automatically Make That Piece Of Land A Waqf Immediately.
Rijiju Said That There Have Been 194 Complaints Against The Encroachment Or Illegal Transfer Of Waqf Property In Only The Last One Year. Is It Then Correct That The Bohras, Ahmadiyas, And Agakhanis Should Be Excluded As Their Numbers Are Very Small? He Has Said That ” Muslim Mps Have Also Told Me In Private That Mafias Control The Waqf Board.
He Said, “Since 2015, We Have Discussed This With 19 State And Ut Waqf Board Chairs And Ceos. Consulted Were Representatives Of Muslim Women, The Agakhanis, The Bohras, And The Ahmediyas.” This Was After The Opposition Had Accused The Government Of Trying To Rush The Bill Through Without Consulting The Concerned Parties.
He Also Added The Complaints That Have Been Received Regarding The Present Waqf Boards: A 1,500-year-old Village Was Declared Waqf Property In Tamil Nadu; The Surat Municipal Corporation Office Was Declared Waqf Property In Gujarat; 29,000 Acres Of Waqf Land Were Diverted For Commercial Purposes In Karnataka. In Mumbai, A Development Project Was Stopped Because Of A Complaint That The Land Was A Waqf Property.
On The Collector Determining If A Plot Of Property Is Waqf Or Government Land: Rijiju Said “Revenue Records Are With The Collector; That Is A Collector”. Collectors Are Independent Of All Political Parties
On The Composition Of The Tribunal: It Is A Constant For The Judges Of The Tribunal To Be Retired. “Technical Members Are Officials,” He Said In Response To Criticisms About The Tribunal’s Makeup.
90 Days Would Pass Between Receipt Of An Appeal By The Tribunal And Its Resolution In Six Months. This Would Result In Solving Thousands Of Now-outstanding Cases. He Justified Of The Bill Saying, “Technology Would Be Employed For Effective Operation And The Ministry Will Supervise All Waqf Papers.”
“The New Central Waqf Councils And State Waqf State Boards Will Be Mandated To Have Women Representatives Included. Besides, There Shall Also Be Representation Of Other Muslim Communities, Including The Bohra And Underprivileged Communities,” Rijiju Said.
Members Of The Opposition Parties Had Already Declared The Waqf (Amendment) Bill, 2024 To Be Unconstitutional And Opposed Its Introduction. The Members Today Ransacked The House, Objected To The New Bill’s Inclusion Of Non-muslims On The Central Waqf Governing Council, Asking If Muslims Should Sit On The Boards That Oversee Temples Such As The Ram Temple In Ayodhya.
On The Other Hand, The Nda Members Were In Support Of The Bill And Claimed That The Bill Aims Towards Making The Waqf Board More Transparent.
The Union Minister Of State For Minority Affairs, Kiren Rijiju, Today Placed The Waqf (Amendment) Bill, 2024 On The Floor Of The Lok Sabha During The Ongoing Monsoon Session Of The Parliament. The Bill Proposes To Amend The Existing Waqf Act, 1995 (As Amended In 2013) By About Forty Points.
The Minister Accepted The Amendment And After A Very Heated Discussion The House Sent The Bill For Detailed Examination To A Joint Parliamentary Committee.
Sec 3(R): ” Waqf” Means The Permanent Dedication By A Person Professing Islam Of Any Movable Or Immovable Property For Any Purpose Recognized By Muslim Law As Pious, Religious Or Charitable.
Section 3(R)(Iv): Waqf-alal-aulad (An Endowment For The Donor’s Family), To The Extent That The Property Is Dedicated To Any Pious, Religious, Or Charitable Purpose Recognized By Muslim Law; Provided, However, That In The Event Of A Failure Of The Line Of Succession, The Income Of The Waqf Shall Be Spent For Welfare [maintenance Of Widows, Divorced Women, And Orphans In Such A Manner, As May Be Prescribed By The Central Government] And Other Objectives Recognized By Muslim Law.
The Role Of The Collector Is Introduced In Section 3(Da), Who Will Exercise Part Of The Authority That Was Previously Exercised By The Auqaf Board. The Insertion Of Sections 3a, 3b, And 3c For The Management Of Waqf Properties.
Section 3a: Waqf May Be Created By: 1. Individual—only The Individual Who Is The Legitimate Owner Of The Property Can Create Waqf And Who Is Competent To Devote Or Transfer The Property; 2. Creation Of Waqf-alal-aulad– The Hens, Including Female Hens, Shall Not Have Their Iirpaws Rights Denied As A Consequence Of Or Incident To The Creation Of Waqf-alal-aulad.
